Code of Criminal Procedure, 1973 – Section 482 – Quashing of criminal proceedings under Indian Penal Code, 1860 (IPC) – Section 34, Section 406, Section 420 — delay in lodging FIR – dispute between the parties is primarily civil in nature and it is only after the civil remedy has become barred by time the instant complaint has been filed – High Court was not justified in refusing to quash the proceedings which are liable to be quashed — Appeal stands allowed.
